WASHINGTON: Former US President Donald Trump cannot fight his suspension from Twitter in the Federal Court of Florida, but instead must comply with the provisions of social media services and Sue in California, following the judge’s verdict.
US District Judge Robert Scola in Miami said in a written order on Tuesday that Trump was tied by the “Forum Election Clause” in the Terms of Twitter Inc.
service, which mandated the demands of certain lawsuits against federal judges in the northern District of California.
Trump lost its social media megaphone this year after the company said he violated their policy of glorifying violence.
The problem of his supporters launched a deadly attack on US Capitol on January 6 after Trump’s speech repeated his fals claims that the defeat of the election was the result of widespread fraud, a statement rejected by many trials, officials of the election of the country and its own members.
Trump’s lawyer argues that his Twitter account is “public forum” and “government entity,” and therefore falls below the exception to the Twitter forum selection clause.
Scola rejected this argument, said the forum election clause “valid and mandatory, and” the status of the former Trump as President of the United States did not prevent the application of the forum selection clause.
“John Coale, said a lawyer for Trump, said in an interview that he was not surprised by the verdict because the forum selection clause was often considered binding.” We think this is a longshot from the start, “said Coale.” We hope there is a decent shot, we will end.
We will end California.
“Earlier this month, a different judge transferred Trump’s lawsuit brought from YouTube Alphabet Inc., involving related arguments, from Florida to California for similar reasons.
Trump sued YouTube and Twitter in July, accusing them unautially silencing the point of view Conservative.
He also brought a similar case against Facebook Inc.
Law demands, submitted in the Federal Court in Miami, accused the California-based social media platform violating the right to freedom of speech with the first Amendment of the US Constitution.
