Jaipur: The Urban and Housing Development Department (UDH) contemplates the proposal to facilitate restrictions on building construction that is close to the Cantonment company or defense of 500 meters to 100 meters.
However, the final decision will be taken after deliberation with the Ministry of Defense.
According to the proposal, construction up to 15 meters (four floors) will be permitted.
A official said, “Jaipur Development Authority (JDA) has continued the proposal to UDH.
If approved, it will not be mandatory for the owner to obtain a Certificate of Objection (NOC) there is no construction activity within the limits mentioned.” Previously, the Rajasthan High Court had still followed The UDH Department issued on June 12, 2017 where the state government has attracted previous restrictions entered by the Building Regulation JDA, 2010.
The state government was asked not to allow any construction within a 500 meter radius of the army area limit without finding a certificate of not objection beforehand (NOC).
Union of India through the station commander, the South-West order filed a challenging petition of the UDH command that had attracted restrictions in the fields of the army.
An official said, “The final decision will only be taken after seeking legal advice and defense officials.” The source said, before, to maintain security standards, the army had written to the state government and JDA to limit construction near the boundaries of military region.
A proposal was also provided to prepare separate graceful regulations to carry out construction near the defense area.
The official source said, “The proposal to reduce the lid from 500 meters to 100 meters was transferred when thousands of construction and renovation was affected.
There were cases that JDA itself allocated a plot within a radius of less than 500 meters from the limit of military areas for construction,” said a man source.
Besides Jaipur, in Rajasthan there are 10 defense companies where NOC is needed including Mount Abu, Ajmer, Nasirabad, Bikaner, Saparh, Alwar, Bharatpur, City, Jodhpur, and Jalipa.
The Defense Ministry on October 21, 2016 issued a circular stating that any construction activities or repairs in a 10-meter limited zone will require NOC beforehand from LLA / Defense local military authorities.
“Following this, the UDH Department issued a notification to inform all civil bodies throughout the country.
Because of this, construction in many plots is affected,” added the source.
