Lucknow: In a recent order, Lucknow Bench from Allahabad High Court has guaranteed a defendant who was arrested for having 350kg marijuana illegally.
The defendant has been imprisoned since January 18, 2019.
The order comes from the Siddharth judicial bench at Plea Guaranteed One Kaleem.
The Narcotics Control Bureau (NCB) has arrested the defendant with a heavy PTUP item and therefore posted it under the NDPS law.
A FIR has been filed in this connection with the NCB police station in January 2019 in Ayodhya District.
Arrupting Plea Bail Before HC, the defendant begged that the recovery was planted because of the hidden motive and therefore he was innocent.
It was also submitted that there were no independent witnesses for marijuana recovery.
“There is no obedience to the provisions of Part 50 of the NDPS laws that ask charges if he wants his search from the judge,” added the defendant.
He also lived on a bench if he was released with a guarantee, he would not abuse guarantee freedom.
Against PLEA Bail, NCB advice argued that there was no chance to plant otherwise marijuana with the defendant.
It was also said that innocent could not be decided at the pre-stage of this case.
“If the defendant was released on a guarantee, he would be involved in the same activity,” added NCB.
