DEHRADUN: Even a former Congress MLA has warned Uttarakhand was moving to get a”constitutional crisis” because BJP chief minister Tirath Singh Rawat – that accepted the oath at March this year and has to acquire an assembly chair from September 10 – can’t contest bypolls according to law because meeting elections are under a year off.
Uttarakhand is place to head to polls early next calendar year.
Based on Nav Prabhat, that was transport minister from the Harish Rawat authorities, provisions of section 151A of the Representation of the People Act mandate a bypoll can’t be held at a scenario where a year is abandoned for state surveys.
“The country is going towards a constitutional catastrophe.
CM Tirath Singh Rawat’s six-month tenure ends on September 10, BJP will have no choice except to mention a new chief minister,” Prabhat told TOI.
He explained that in 1 case in Punjab, the Supreme Court predicted the reappointment of a ministry – that wasn’t elected in six weeks – as invalid and unconstitutional.
Uttarakhand agriculture ministry Subodh Uniyal, however, claimed that the Congress had been attempting to deceive people through half-baked details.” Two assembly chairs – Gangotri and Haldwani – are lying empty.
Gangotri seat fell vacant on April 22 following the passing of Gopal Rawat while Congress MLA in Haldwani, Indira Hridayesh passed out this month.
Tirath Rawat is very likely to competition from Gangotri.
