New Delhi: The Supreme Court on Monday said that the Prima Facie was not satisfied with the Probe of the Government of Uttar Pradesh into the violence of Lakhimpur Kheri.
Retired High Court Judge Allahabad Pradeep Kumar Srivastava was named after the previous state government to ask for the eruption of violence on Jalan Tikonia-Banbirpur in Lakhimpur Kheri Regency.
The court statement came after attaching the government status report in this matter.
In accordance with the latest order, the state government is placed in the details of the investigation details conducted in connection with the Lynching incident too.
A bench led by the Chairman of the NV Ramana Judge, in an audience carried out through video conferencing, it was suggested to the state government that monitoring the ongoing probe was carried out by the former judge of the “different high court” to instill “independence, impartiality and justice” BJP workers, a driver, and a journalist, died in clashes in Kheri Kheri on October 3, following violence after the convoy of three SUVs – including those allegedly owned by Ashish Mishra, Son of Union Minister of Justice Ajay Mishra.
The bench refers to two fir , one related to cutting farmers and others related to the next BJP activist lynching by the horde, and said that the Prima Facie appeared that the evidence was being built to protect the defendant in the first case.
“One more thing, which is in our minds to ensure that proof in FIR no.
219 (Case Mowing Farmers) are recorded independently and in FIR NO.
220 (casing lynching) is also recorded independently and does not overlap or mix two set evidence.
“We tend to appoint a former judge about different high courts to monitor investigations every day and then see how separate cost sheets are finally prepared,” said the bench.
Speaking for benches, Surya Kant’s justice suggested the names of Ranjit Singh judges and justice Rakesh Kumar Jain, both former judge of the Punjab High Court and Haryana and said that they were experienced in the field of criminal law and would oversee the probe to sit up to archiving costs in the case.
The state government must respond on November 12.
The police so far caught 13 were accused, including the State Minister for the Union for the house of Mishra’s Son Ashish Mishra, in connection with this case.
