Chennai: The evidence of blind sexual harassment survivors could not be punished on the ground so he was visually disturbed, said Madras HC while enforcing the court of court which was awarded a seven-year prison to a driver of the Autorickshaw who had attacked women.
According to the prosecution, the driver of the Autorickshaw Anbu Selvan was hired to transport congratulations to the music class.
Taking advantage of his disability, he took him to a remote place and seduce him sexually.
He even tried to kill him.
Challenging the court command of the court gave the term seven-year prison to him, Selvan moved HC which said the proof was unreliable when he was blind.
He said, “The identity of the defendant was not proven in a way that was known to the law and since the witness (Survivor) was a blind person, the proof could not be called an eyewitness if at all, it could be called a witness of the existing Hearsay in the evidence.” RMT justice Teekka Raman is called Selvan as a “heartless person” that has utilized helpless situations from people who visually and attacked them sexually.
He has no right to reduce punishment, even for one day, the judge stressed.
He said, “Just because of disability, the evidence of disabled people cannot be treated as the nature of inferior.
Survivor as a blind person has no vision, but his version has a vision and therefore, this court argues that the evidence of survivors cannot be accepted in the evidence.” He confirmed The penalty given by the court court.
