Mumbai police late on Monday arrested the businessman Raj Kundra, husband actress Bollywood Shilpa Shetty, for allegedly making porn content and publishing it through a cellular application.
He has been sent to the guard for the sun until July 23 along with his colleague Ryan Tharp, who was also arrested in the same case.
On Tuesday, Kundrra’s lawyer fighting in court that it is not true to classify content as pornography.
He also objected to the application of Part 67A from the Information Technology Law on sending obscene content in electronic form along with other parts regarding pornography because this law considers “sexual relations” as vulgar content.
The lawyer then said that the police followed what the web functions today – vulgar content.
However, it is not classified as porn.
He added that there was nothing in this disposal which showed that two people were spoiled in intimate relationships.
Therefore, it cannot be called porn.
Talking about the arrest of Raj, a lawyer said that the arrest must be made only when the investigation cannot continue without it.
And in this case, the defendant was carried out to join the investigation after his arrest.
The lawyer concluded that the arrest of Kundrra was not made according to the law.
Raj Kundra has been seeking anticipatory guarantees in this case.
Also, the police clarified that they could not find the involvement of Shilpa Shetty in the same case.
