Kochi: Is a wedding under a special wedding law can be undertaken videoconferencing: This is the question of the Kerala High Court which was checked on Thursday, before ordering a decision.
PB Justice Suresh Kumar heard the argument on behalf of the state government, which did not support wedding online solemnization under the action, and some applicants who had argued that the physical presence of the bride was not needed under the law.
The state government said that under the action, marriage solemnization was mandatory before registering it under action and therefore, the presence of both parties and witnesses was needed before marriage officer.
Also say that if the online settlement mode is permitted, it will mandate maintaining an electronic wedding list and setting online payment modes, both of which are not currently available.
This adds that other requirements for wedding solemnization is that at least one of the two parties must be a resident of the region within the territorial boundaries of marriage officer for a minimum of 30 days before issuing the intended wedding notice.
Therefore, two people who live abroad cannot marry their wedding online if they do not meet the requirements of the stay.
The applicant has argued that when marriage under laws can be registered online, the solemnization also does not require the physical presence of the parties involved.
They have claimed that there are various assessments, which say that appearing through video conferencing similar to attend directly by the only difference of the party cannot be touched.
They say that under action, marriage can be stated in any way, such as the exchange of flower bouquets or hand shocks, as long as both sides make the declaration they take each other as husband and wife who are trusted.
They also say that the signature can be delivered through digital format and the same is recognized under the Information Technology Act.
