New Delhi: The Supreme Court on Friday asked the Uttar Pradesh government to withdraw the recovery notice of the anti-CAA protesters and warned that it would cancel the trial for violating the law.
The top court said that the Government of Uttar Pradesh had acted like “complainants, adjudicators and prosecutors” by themselves in conducting trials to attach the properties of the defendant.
“Drag the process or we will cancel it for violating the law set by this court”, Judge Dy Chandrachud and Surya Kant said.
The Supreme Court observations came in response to the request submitted by Parwaiz Arif Titu who was seeking notice dismissal sent to the alleged protesters by the District Administration for recovering losses caused by damage to public property (ACT (CAA) anti-citizenship (AMUNDENT) in Uttar Pradesh .
Request it alleges that such notification has been sent to the “arbitrary manner” against someone, who had died six years ago at the age of 94 years and also to several others including two people over the age of 90.
the application also sought a Directions to the Government of Uttar Pradesh to take part in the 2009 and 2018 procedure concerning the APEX court while claiming damage to recover losses caused by the protest during the protest.
In 2019, the Head of State Minister Yogi Adityanath stated that the cost of damage to the properties during anti-legal protests -The work will be “dilated “with a fine collected from those responsible.
More than 300 people presented notice the cause of the show in connection with damage to public property.
It was identified based on CCTV and video recording of violence, the defendant was asked to explain why their assets should not be attached to compensate for losses to public property.
If the notification released cannot explain that they are not responsible for the loss, they must pay.
Officials said that the notification was presented based on the 2010 High Court order which directed the state government to compensate for losses for public property caused during the agitation of violence from those involved in such acts of violence.
