New Delhi: With a very opposing center holding Kanwar Yatra, the Supreme Court on Friday said that the movement of such worshipers could not be allowed at the time of the third wave of Covid-19 was soaring, and asked the Government of Uttar Pradesh to reconsider his decision and not allowing Yatra, even symbolically.
Judge R F Nariman and B R Gavai said Covid influenced every Indian citizen and their health and their right to life guaranteed under the constitution could not be compromised.
The court made it clear to the country that he reconsidered his decision and called Yatra, failed where the court would be OK.
When the government rises in response to “positive” of the suggestion of the court to reconsider the decision, the bench respects the stand and postponed the trial for July 19 and asked the state to submit a new written statement about the decision on that day.
“We have the view that this is a problem concerning everyone from us as an Indian citizen, and goes to the heart of Article 21 of India’s Constitution, which has the pride of the place in the Chapter of our Constitutional Fundamental Rights.
The health of Indian citizens and their rights to” life “is Most importantly.
All other sentiments, even though they are religious, subject to the most basic fundamental rights, “Bench said.
The center and the state submitted a written statement after the APEX court took Suo Motu’s awareness of media reports related to the country’s decision to allow Kanwar Yatra.
The court also noted that the State Stand was contrary to PM Modi’s recent statement that “we cannot compromise even a little” on a pandemic.
Senior Advocate Cs Vaidyanathan, appeared for the state, told the bench that the government only held the Yatra Kanwar symbolically and only the minimum number of worshipers, which was fully vaccinated with the RPCR negative report carried out in the last three days, will be allowed to participate.
He convinced the court that strict compliance with the Covid protocol would be followed.
But the bench is even symbolic Yatra should not be permitted and the center also argues that the state government should not allow Kanwariyas’s movement because it carries Gangajal from Haridwar to their temples.
The center, represented by lawyers General Tushar Mehta and the additional lawyer General Aishwarya Bhati, said some alternative settings must be made for worshipers remembering the habit of age and religious sentiments attached to Yatra.
Mehta said the state must develop a system to make holy gangajal available through tankers in various places throughout which state can be taken and used to do “Abhishek” at the nearest Shiva temples.
“The state government must also ensure that gangajal distribution exercises among worshipers and rituals that will be carried out by worshipers near Shiva Temple occurs mandator to ensure social distance, wear masks and compliance with all the steps needed for Covid behavior and protocols Health, “the center said in his response.
