New Delhi: The Supreme Court on Friday told thousands of home buyers Amrapali not to expect compensation for delays in getting a flat as a court trying the best to protect their interests somehow all resolve all residential projects left in Limbo by the company’s promoter.
“You get Lassi but don’t expect MaIs for Lassi,” said Justice Lalit Law in a lighter vein to advocate for ML Lahoty, which raised the problem of compensation as a home buyer will get ownership after an uncontrolled delay, which in some cases is about a decade .
The court said it would be too much from the court to get compensation along with ownership.
Judge Lalit and Ajay Rastogi said it also did not ask home buyers to postpone as many payments as possible to stop paying installments for years and still haven’t done it even after the construction of a housing project was carried out under the supervision of the court.
“You try to draw more benefits for home buyers.
But we can’t allow it.
We reject the request.
We also don’t ask you to pay interest by default on the home buyer section.
If we allow a compensation delay to one Homeyer, then all will be looking for compensation , “said the bench.
Compensation requests will further postpone the projects of Amrapali as a court and recipient appointed by the court to explore various options for collecting money to complete projects.
Senior Advocate R Venkatatamani, who as a recipient appointed by the court managed the affairs of the Amrapali group, also opposed the buyer’s request and said “to request a compensation too far”, which should not be permitted.
When the court was told that around 2,500 flats would be ready to have at the end of this year if Rs 200 Crore was available for NBCC, the court directed that the flat buyer had to clean their contributions on October 15.
It is said that flat allotment will be canceled to those who fail to clean their contributions and the flat will be auctioned.
Venkatramani also told the court that public notification would be published in newspapers in the coming week of R flat-apartments that have so far still not claimed and if nothing advances to claim them then the flat will be sold.
“…
it has emerged that 9,538 home buyers do not register so far in customer data mentioned by the recipient’s office, also does not make payments, then with the Supreme Court assessment in July 2019,” the recipient said in it.
He also told the bench that there were 6,210 home buyers who did not make cleaning their contributions.
