New Delhi: Hands that provide a gun or motivation to take it equally responsible when the hand that finally annoys, the Delhi court said on Monday, while sentence two members of Hizb-ul Mujahideen to 10 years in prison for conspiring to do Terror activities in India and fight against the country.
While MD Shafi Shah and Muzaffar Ahmad Dar were given a 12-year gun, Talib Lali and Mushtaq Ahmad alone got 10 years in prison.
They are punished for a criminal conspiracy and various parts of the activity (prevention) that violates the law.
Additional session Judge Parveen Singh said, “The convicts may not be demanded for direct terror acts, but proxy wars in J & K have raged since the decade have resulted in the loss of many lives and destruction of property.” The convicted convicts are charged to be involved in terror financing activities.
It was said in their behalf that there were no cases against them because they had actively participated in terror activities, so that soft views needed to be taken because their actions did not result in loss of life or property.
“In that face, this argument seems very strong.
However, I find that the hand that provides a gun or motivation to take a gun is equally responsible when the hand that finally fired the weapon,” said the judge.
Further note that prisoners have provided funds for the activities of HIZB-UL Mujahideen (HUM), which are used for the destruction of property and taking human life.
Just because prisoners are not directly responsible for loss of life and property, it is unacceptable that they are not responsible for this because of the terrorist activity of hum.
“I found that the funding network run by this convict in the instructions of those who sit in Pakistan have a greater responsibility for the acts of terror conducted by hum.
In the absence of funding cadres hum and providing logistical support, it is not possible to carry out terrorists .
I find that terror funds must be stored in the same category as actual acts of terror, if not in a higher category, “said the judge.
The court further said the crime was “very serious properties” when inmates had hatched conspiracies to attack the nation’s core and the actions were taken to carry out the conspiracy.
This case was filed on charges that HUM had regularly received funds from neighboring countries through Pura-Pausaan Temple Jammimfmir to carry out terrorist activities in India.
The accusation pleaded guilty of all charges and was punished on October 4.
