Lucknow: Lucknow bench High Court Allahabad has set aside a list of seniority issued on November 22, 2019, promoting the Civil Police Inspector to the position of Deputy Supervisory Police (DSP) above the police.
Directing the state government to prepare a list of joint joint supervisors posted in civilian police and in armed police (PAC), following the rules of 7 of the rules of the 1991 government employee seniority.
Then direct the State Authority to complete exercising in a month.
However, asking the state government to not return two inspectors that have been promoted from the civilian police to the DSP post to the conclusion of promotional training after preparation from a list of shared seniority.
The two DSPs were promoted by the opposite party in the application, but they did not appear before the court to put their stands.
Judicial bench Dinesh Kumar Singh passed orders at the direct petition moved by PAC Inspector Vijay Singh.
The applicant begged that two of his junior inspectors in the civilian police were also promoted at the DSP post based on the list of seniority prepared on November 22, 2019, but he was not considered for promotion illegally.
In the hearing, the bench found that the applicant had made a representation to the DGP against the list of seniority prepared from the only civilian police inspector to the rules of 1991.
DGP was a committee of two members who considered this problem and found that the seniority list was prepared based on government orders issued on July 24, 2003, but in fact, said GO did not exist.
The committee hence submits its report that the combined seniority of the inspector list, consisting of civilian police and PAC, must be prepared, but even then nothing is done.
Letting the petition, Bench said, “Recognized, the list of seniority derived from November 22, 2019, has not been prepared in accordance with the 7 rules of 1991, but has been prepared in accordance with the Go of Go of July 24, 2003.
The Committee has recommended that the list of shared seniority will be prepared accordingly With the rule of 7 rules 1991.
