MADURAI: Some allowed the appeal to be preferred by a man against his belief and punishment by the trial court in a case where he refused to marry a woman after impregnating him, Madras High Cours pointed him to pay the compensation of RS 5 Lakh’s son the relationship, observed that it was a real victim in this case.
According to prosecution, M Malaisamy from Ramanathapuram has promised to marry a woman who falls in love with her village and they have a physical relationship.
However, after the woman was pregnant, she refused to marry her push her to file a complaint against her and a registered case against her.
In 2015, the court court at Ramanathapuram was punished and punished the man underwent a 10-year imprisonment for sexual violence based on part 376 IPC and a one-year imprisonment to cheat under the 417 IPC section.
Malaisamy challenged this through the current appeal before the HC Madurai bench in 2015.
Justice R Pongiappan observed that it was seen that the applicant and the woman had a relationship.
The woman agreed to a physical relationship with the applicant.
Because the relationship was consensal, the defendant did not need to be punished for sexual violence.
However, the judge observed that the applicant’s actions that had refused to marry the woman after impregnating her will definitely be under the scope of cheating.
Therefore, the judge punished and sentenced the Petitioner to undergo a one-year imprisonment for cheating.
Judge further observed that because of the actions taken by the applicant and the woman, the child lost his status to be a legitimate child.
Observing that real victims in this case were children, the judge directed the man to pay RS 5lakh assistance to the child.
The woman can attract interest that must still be paid once in 3 months and use it for the welfare of the child, the judge said.
