New Delhi: After a few years of gap, the Delhi High Court on Friday continued substantive hearing in a group of petitions who wanted to criminalize marital rape.
Judge Rajiv Shakdher and C day Shankar heard arguments from the applicant’s organization who wanted a court to attack exceptions given under Indian punishment that protected husband and wife to rape their wives.
Senior Advocate Colin Gonsalves, represents the applicant of women, argues that trials around the world have recognized marital rape as a violation and canceling the concept of permissions that cannot be canceled to build sexual relations.
Gonsalves relied on a series of assessments passed by courts in the UK, USA, Canada, the European Union and Nepal and international agreements to submit that the argument as whether assumed could not be maintained.
He said the Supreme Court Nepal had observed that Hinduism did not release the “wife of the wife of a wife”.

The applicant has challenged the Constitutionality of the IPC 375 for reasons that discriminated against married women who were sexually attacked by their husbands.
Meanwhile, the Delhi government in a brief submission told HC that the marital rape had been borne as a violation of atrocities under the IPC and was not true to claim that the victim did not have the road available in law.
His advice, Nandita Rao, said that married and unmarried women were placed differently under each law and showed that cases were listed under the IPC 498 in such cases because the marital rape was atrocities for the wife.

This center said the marriage rape could not be done for criminal acts because it could penetrate marriage institutions and become an easy tool to harass the husband.
