Gahati HC Quashes Big Cases in Birds and Animals 'Rare'

Guwahati: The Gahati High Court canceled a delayed customs case in the High Court in the Golaghat Assam district against three people after the court found animals and birds seized from the defendant not “prohibited items under page 2 (33) from the Customs Law 1962 “.
The High Court heard the criminal petition submitted by Arjun Agrawal aka Arjun Agarwal, MD Farooque and Ayaz Khan in May.
The applicant is the defendant in a customs case.
Police in Golaghat on March 14 intercepted vehicles in Ghiladhari in the Ghiladhat district and restored eight silvery marmosets, two golden heads of the Tamarin lion and two Lutino’s blue and gold macaws from the applicant.
The police, after finding the applicant had collected animals and birds from Imphal in Manipur and were on our way to Chennai, handed over animals and birds along with the defendant (the applicant here) to the Range Forest Officer, Jamuguri Range in Golaghat.
However, the Forestry Department said that animals and birds were restored, exotic, outside the scope of the Protection Law of Margasatwa, 1972 and therefore, asked Numaligarh customs prevention forces to proceed against the applicant and seize vehicles under the Customs Act, 1962.
After that, the people accused of being arrested on March 15 under the 1962 customs law and animals and restored birds were confiscated.
When a saved animal is still alive and good and because there is no rescue center – rehabilitation in Golaghat, they are transferred to the Assam Zoo in Guwahati on the same day.
The applicant in May moved the High Court of Gahati and submitted a criminal petition under the 482 CRPC section which was seeking arrangement of the Customs case, who was waiting in the court of Judge Judicial Court, Golaghat.
