Guwahati: The Gahati High Court on Thursday canceled a lower court process against senior leaders of BJP and Rajya Sabha MP Subramanian Swamy, stating that there was no legal evidence before the trial court when taking the recognition of “speech hatred”.
The last hearing of the petition, submitted by the BJP leader in 2015, challenged a lower court trial in Karimganj District in Assam in the Barak Valley against him held on November 11.
The court has prepared an assessment after hearing.
Senior Advocate Swamy believes the case itself in the High Court as “direct applicant”, and is assisted by a senior lawyer of the Gautati High Court, Mahajan, and others.
Judge judge Single Manish Choudhury on Thursday said an assessment by stopping the process in Judicial Judge Chief Court, Karimanj.
This case was initiated by lawyers from Karimganj, said Rahman Patikar, in the lower court against Swamy for allegedly creating communal disharmony and slandering certain communities while giving a speech in a function held by a private university in March 2015.
Swamy reportedly said the mosque and the church was only a building and can be destroyed, after the FIR filed against it.
After hearing a party, the High Court found that there was no legal evidence before the court court when it admitted complaints.
“Cases, where there is no legal evidence added in supporting this case, the continuation of the criminal process will amount to misuse of the court process,” he said.
After the judgment was spoken, Swamy Tweeted, “Assam HC today rejected the case of hatred speech submitted to me in the Karimganj court.
This is a devastating order against those who submit it and get a warrant issued by Shakuni and Bottle.
2015.” He further Tweeted, “This defeat was a slap in front of those who consumed me in 2015.
