Margao: In a significant development in the case of Grab Land registered by Police Fatorda, an additional session judge court, Margao, has rejected the anticipatory guarantee application submitted by one of the 17 defendants, Francisco Colaco, a resident of Davorlim.
Preaching his order in the Open Court, the additional session of Judge P M Shinde ruled that, Prima Facie, the applicant’s custodian interrogation needed in connection with “fraud mutations from survey ownership” in this case.
“The interrogation of the custody is also needed for other reasons, to recover the alleged sales certificate consumed based on where mutations are carried out.
There is a mystery in the current crime that must be investigated thoroughly and for the purpose of the applicant’s interrogation accused of being needed by the police,” the command rang.
Colaco, together with 17 others, has been charged under 465, 468, 471, 420 of the Indian criminal code by the Fatorda police based on complaints submitted by Salcete Mamlatdar, with the effect that the applicant was along with the people accused of January from January 2018 to May 2020, Title Documents Forged namely Suksesi Deed, Sales Deed, Rental Purchase Certificate, Family Partition Deed and Using It As Original Before Mamlatdar, Salcete, in the process of mutations and got their names in the form of XIV of the properties in question.
They, thus, get the names of the original residents / owners deleted, and when the legal heirs of residents / owners request information under RTI at the Mamlatdar office, 12 relevant mutation files found missing.
That was the case of prosecution that the original succession deed used for the mutation process had not been restored “which can only be recovered from the applicant”.
The prosecution handed over that “mutation entries have been certified in a hurry within 23 days which otherwise will take a long time to resolve it, therefore it can also be concluded that some government officials can also be involved in current crimes”.
