New Delhi: The Delhi High Court withdrew the Delhi government because he did not meet the standards to destroy illegally built temples in the South Delhi defense colony and referred to the issue to the Religious Committee for his approval, saying this would cause chaos and more.
The High Court said the Religious Committee, led by Lieutenant Governor, might be needed if there was a big temple, but if someone put a few bricks last night then referred him to the panel won’t serve the purpose.
“I want to see what the scope? Is just a few bricks placed by someone will fall in the scope of the religious committee’s mandate, that’s the question.
If there is a big temple, the religious committee may be needed but what if someone put some bricks last night?,” said Judge Rekha Palli.
The court noted that the previous Delhi government had proposed that the authorities planned to destroy the illegal structure on October 4, but, now it has referred to the problem to religion.
“There are only a few bricks and 2-3 idols”, the court said while directing the government to record a copy of the order by which the Religious Committee, which is related to the issue of removing encroachment in the form of loading in the form of religious structures, formed.
“This will cause total chaos.
If tomorrow someone only puts five bricks and places an idol, you will say we need a religious committee.
Is that the purpose of the Religious Committee? Today someone puts idols outside the High Court or anywhere, you will Saying now is a religious structure.
There are five bricks lying there and now we will consider whether the religious committee will move them? This is not the way, “he said.
Advocate Anupam Srivastava, who represented the Delhi government, said even the authorities wanted the structure to be removed but they had to follow the mandate of the Religious Committee first and added that they did not avoid removal.
The court said it would not take 3-4 hours to build such structures and add that if it was a governance, “we will have all Delhi waving.
Anyone will put anything.
We sit in court, someone will put something Outside and we will say alright, it’s over.
“The court heard the request to find the elimination of encroachment in front of a property.
The court has issued prior notice and requested a response from the Delhi Government, DCP (South), Hauz is typical of the petition submitted by property owners.
The tree said that during the Covid-19 pandemic, someone who entered without permission and illegally built a temple in public land, namely the path, at Bhishma Pitamah Marg, right in front of the applicant’s property.
The petition claims that taking advantage and taking refuge from illegal construction, people gather there and enjoy Rowdiness and gambling and structures that violate full access barriers to the applicant’s building.
