Justice G R Swaminathan observed that careful readings from written text from the video showed that the applicant was worried about the incident.
This court can take Judicial notifications about the fact that the incident was under bitter and sharp criticism in all media, during the early days when the pandemic hit.
Therefore, a little excessive comment is also acceptable.
The judge observed that without his speech in the video, the applicant questioned the Muslim religious beliefs.
The attack is only at the behavior of irresponsible congregation participants.
The applicant’s intention was that he called participants who participated in the church to go to the hospital and asked themselves to be examined.
In fact, the government itself began conducting contacts and wanted to identify members who participated in the church, said the judge.
The judge observed that sharp criticism of an organization would not attract violations mentioned in FIR.
Therefore, the judge argued that the registration of FIR itself was illegal and canceled it.
Police finished registering cases against Maridhas for controversial videos made by him.
In the video, the influencer of the right-wing social media connects the meeting of the Jamaat tabli held in Delhi in March 2020 with the spread of the Covid-19 pandemic in the country.
He called Tabliggi Jamaat as a form of new terrorism.
This case was registered with the complaint submitted by Tamil Nadu Muslim Munnetra Kazham Pejamin Mohammed Kadhar Meeran on April 4, 2020.
Maridhas was ordered under section 292 (a) (publishsly indecent or material intended to squeeze), 295 (a) intentional and dangerous, intended to prevent religious feelings by insulting religion or religious beliefs) and 505 (II) (statements create or promote hostility or will between classes) from the Criminal Code and transmit or transmit or infect or infect material in electronic form) Invite information technology.
