Ahmedabad: While hearing the case of anti-dumping tasks imposed on Chinese items, the Gujarat High Court bench made a comment that passed on Tuesday that whether you love or hate it, you cannot ignore it.
The High Court has temporarily remain the implementation of the notification issued on Monday to revoke the decision to collect anti-dumping tasks in the FLEX PVC film imported from China.
Justice J B B B Pardiwala and Justice Nisha Thakore is hearing the petition submitted by one QREX FLEX PVT LTD with a withdrawal of appointed authorities from anti-dumping tasks on Chinese goods.
The judges asked the central government whether there might be a uniform policy on this problem.
The court was told that the law mandated investigations and review of quasi-judicials in this matter.
At despair by the local industry on the revocation of anti-dumping assignments, the judges commented, “In the end, do you love China or hate China, one thing you certainly cannot ignore China.” According to case details, the central government has implemented anti-dumping tasks on imports of FLEX PVC films from China in August 2016 for five years.
When settings almost ended in August 2021, the industry association dealing with goods asked the government to review and expand to protect the local industry.
On June 30, 2021, the center extended the procurement of anti-dumping tasks for six months; This period will end on January 31.
But in October 2021, Director General of Trade Cobalah recommended a withdrawal of tasks which quoted the reduction in imported goods from China.
The local industry association approaches customs customs and levels of tribunal services (CESTAT) services to these recommendations.
A week before the end of the extension period, the center issued a notification on Monday and revoked protection for the local industry.
The applicant approached HC and handed over that special bench in Cestat was not available and there was no possibility of decisions about revocation of tasks in a short time.
HC suggested that until the time the court decided to appeal, the court could continue to operate notice for four weeks.
