New Delhi: Lok Sabha on Monday issued a bill to correct mistakes that had crawled into narcotics drugs and psychotropic substances (amendments) acting with Finance Minister Nirmala Sitharaman stressed that the retrospective provisions made in the bill were not substantive.
Most of the opposition parties voiced concerns over retrospective provisions in the bill.
The NDPS bill (amendment), 2021 passed by voice and some amendments transferred by opposition members were rejected by the house.
Responding to the concerns submitted by members that the provisions for implementing laws with retrospective effects of violating Article 20 (1) Constitution, Sitharaman said in the opinion of public lawyers, amendments can be permitted because they are not substantive, but pleivicatory in nature.
He said retrospective amendments were permitted because the government did not want to create new law but only fix errors.
Congress, Trinamool Congress, BJD, left and others declared their fear of bills that enabled the Implementation Agency to control.
