Mumbai: Governor of Maharashtra B S Koshyari signed the procedure for giving OBC quota in the local rural agency poll on Thursday, the day after the State Cabinet made him a revised version.
Koshyari previously returned the original procedure to the state after raising the question, which had raised the MVA government hacking.
The state is expected to send other regulations that provide OBC quota in urban local bodies this weekend.
The State Election Commission (SEC) previously said that regulations regarding rural polls would not have an impact on Bypolls to the six zilla parishes and their Panicis Panic which was due on October 5 since the submission process had ended.
“We will take the procedure for the State Election Commission and ask whether the selection process for Zilla Parishad Bypolls can be canceled and revived to allow quota.
If necessary, we will approach the Supreme Court,” said the Welfare Minister OBC Vijay Wadettiwar.
“The state must go before SC to make changes to the Bypolls because the case for the OBC quota is before the court,” said a senior Second official.
The source said that the Governor Koshyari had looked for several clarification.
A senior state official called him on Tuesday and explained the problem raised before sending an amended procedure.
The source said that the Governor Koshyari asked about the lack of empirical data on OBC, which was requested by SC.
“We explained that it would take time to provide data and there were many local agency polls scheduled for the next 6-8 months, which must then be traversed without the OBC quota,” said a senior official.
He also said they explained how difficult it was to extract OBC data even from the central socio-economic census.
The governor also asked SC to be informed about the rules before it was announced, based on the legal view and the State Justice Department.
“However, we explain SC is not shown by the draft legislation before being applied,” said a senior officer.
The State Ordonance provides an OBC quota in polling the local rural body by changing the law of the states.
Quota has been canceled by SC in March.
Ordonance allows the OBC quota on a rural body with motorists who have been combined with SC and ST reservations, the combined quota will not cross the 50% limit.
Also, the OBC quota will not cross 27% of the chair, according to the existing state legislation.
