Kathmandu: The head of the Supreme Court of Justice Nepal Cholendra Shumsher Rana has refused to resign from his position in the midst of the guess that he helped his brother-in-law secure the bed in the cabinet led by Deuba who was unusual, triggered an unusual judicial crisis.
Part of the Chief Justice has demanded the resignation of the chairman of the judge while some lawyers decided to boycott the peak court.
During the meeting with 15 APEX court judges on Tuesday, Rana said that he would not go down only because the voices were raised on the streets and in the media for him to get out of the top post.
“Rana told the judge that he preferred to face constitutional procedures but would not leave the post,” said Spokesman for the Supreme Court of Baburam Dahal to PTI.
“I will not retreat under any pressure but follow the legal procedure if needed,” Rana said as quoted by Dahal.
The lawyers have decided to boycott the Supreme Court while the judge is busy holding a meeting, affecting the audience, just as there are thousands of cases delayed.
Nepal Bar Association has also warned for the stage of national protests if the shutter does not resign voluntarily.
A spokesman for the Supreme Court of Dahal, however, said that several judges had begun to return to their normal work from Wednesday.
According to the constitutional provisions, 25 percent of parliamentarians at the House of Representatives can submit an impeachment movement to the main justice and it requires a third majority vote to support the impeachment movement that leads to the elimination of major justice.
The shutter faces allegations entering the Quid Pro agreement implied by the executive by trying to induce his brother-in-law in the cabinet led by Prime Minister Sher Bahadur Deuba as a gift for the government of Prime Minister KP Sharma to dissolve parliament twice.
However, the shutter has rejected the allegations labeled against him by the Nepal Bar Association and several Supreme Court judges.
Minister of Industry, Trade and Equipment Gajendra Bahadur Hamal has submitted his resignation of 48 hours after being appointed to the cabinet led by Deuba on October 10, following the media report that he was appointed as a recommendation for the chairman of Judge Rana.
However, the judge demanded the resignation of the shutter, because the removal of the minister about this problem was not enough because it would tarnish the image of the judiciary.
