Pune: The family court in Pune has provided a divorce with a joint agreement for an engineer for 14 days after they jointly present a petition and secure the neglect of a mandatory six-month cooling period.
The husband, who came from Uttar Kannada Regency in Karnataka, was hired as a project manager with a company in Dubai while his wife, which was a software engineer, remained at Talegaon Dabhade.
Their marriage is earnest on December 12, 2017, under special marriage laws.
However, the pair began to live separately from April 26, 2019, because of differences of opinion and incompatibility.
After all the reconciliation steps failed, the couple presented a shared and voluntary petition through their lawyers, Mayor Salunke and Salaunge Ajinkya, 14 days ago looking for divorce with joint approval.
Judge M R Kale observed the verdict on September 29 that the two parties had undergone separation period for more than 18 months.
Thus, there is no need to make them wait for more than six months for the cooling period as stipulated in section 28 of the Special Marriage Law, the judge said.
Judges further observed that the wife had released its rights for maintenance, and that husband and wife would not have claims to their respective properties, both of them moved and did not move.
The judge said that there was also no disputes about Stridhan and other articles, and that there were no claims delayed by each other.
The judge said the marriage council was also submitted a report stating that there was no possibility of reconciliation between couples.
Thus, this is a fit case for divorce decision with mutual agreement, the judge ruled.
The Supreme Court previously decided that the six-month cooling period could be released if there was no possibility of reconciliation between the alienated partner.
Marriage can be stopped legally only in a week, especially in cases where the couple lives separately for more than a year, the command of the Supreme Court has said.
