Rome: The court in Italy defended his belief in two young tourists from California for the murder of 2019 from an unarmed Italian plainclothes police officer on Jalan Rome, rejecting the argument of self-defense blatantly unreasonable.
Lawyers for the defendants on Tuesday were provided with copies of written motivation for the punishment and punishment of the life of the Rome Court for Finnegan Lee Elder, 21 and Gabriel Natale-Hjorth, 20.
Italian courts needed, within 90 days of the verdict, to formally detail in writing Why did they decide the verdict and punishment, with the reason they formed the basis of the final request by defense or prosecutor.
Lawyers for the defendants were studying documents and did not immediately comment on the appeal.
In the 346-page document signed Monday by the Presidential Judge’s Presidential TRAL President, the Court rejected the defense argument that the defendants did not know they were approached by police officers near their hotel in the early hours of the morning of July 26, 2019.
It refused the victim, Deputy Brigadier Carabinieri Mario Cerciello Rega 35, who recently returned from his honeymoon, or partners in plainclothes of thugs did not identify themselves as police.
Cerciello Rega was stabbed 11 times by Elder and Partner, Officer Andrea Varriagle, a little injured in a fight with Natale-Hjorth before America ran back to their hotel.
The defendants were convicted of murder, trying to extorze, fighting public officials and carrying an attack style knife without only cause.
In Italy, a hand in alleged murder can also be charged with murder without murder murder.
The two defendants began serving a life sentence, the hardest punishment of Italy.
Elder testified that Cerciello Rega attacked him without cause and tried to strangle him, so he took the knife he brought for his own protection and stabbed the officer repeatedly to free himself.
“How did the court not ask myself why Deputy Brigadier Cerciello, in service for more than 20 years, about whom all talked about his professionalism, his dedication to work, his experience on the streets, his humanity, had to suffocate the elders as the defendant argued?” The court wrote , The trigger court in the termination of the main defense argument, adds, “and if the intention of the two officers will kill, why does Varriale do not do the same thing with Natale, leaving uncomfortable testimony?” Officers followed up on extortion efforts which were reported allegedly made by America after bidding to buy cocaine in the Nightlife Trastevere Rome district that occurred several hours before stabbing.
The defendants testified they had paid 80 euros ($ 96) for drugs but did not accept it.
In retaliation, America claimed the first-owned backpack of a failed agreement and demanding money and cocaine in return on returning bags and cellphones contained.
The two Americans testified, they thought Cerciello Rega and Varriagle were criminals or Mafah who appeared at the meeting place that was set instead of going and acted to defend himself.
Varririe testified that the two officers went to the meeting without their service weapons and both showed their police badges and notified Americans that they were officers.
“In the end, the only protection (unarmed officer) at this time was exactly the badge,” the court wrote, noted that Cerciello’s blood-covered wallet was then found.
“Deputy Brigadier Cerciello could not offer his version, but his martyr’s body spoke for him and proved to anger that killed the elder,” the court wrote.
