New Delhi: The Supreme Court on Wednesday rejected the Maharashtra government’s request to get raw data from the center in other backs classes (OBC) in the state, collected under the census of socioeconomic caste (SECC), after being told that the data was defective and could not be used .
Judge A M Khanwilkar and C T Ravikumar asked the state to do their own exercises to collect the data and submit an objection to the country that insisted on obtaining “defect” data that could not serve the purpose obtained by the center.
The court also pulled over the country and the center to not help the court in providing a clear picture of how data was collected and whether there was legal force behind the decision taken by the executive to do exercises after the Public Lawyer Tushar Mehta told the bench that the Collection of OBC data was not part of the census 2011 and done separately.
The bench said he could not continue in the case based on “IFS and Tongs” and rejected the petition.
This allows the state to pursue the case to get data before the appropriate forum and shows that it can apply under the information law.
Senior Advocate Shekhar Naphade, emerged for the state government, told the bench that the center told parliament that the data was 98.87% accurate and the state had the right to find out about data.
But the lawyer General said many countries had done exercises to collect data relating to OBC and Maharashtra also had to do it and did not demand data “unreliable”.
“Because of the errors made by the enumerator, defects attached by conducting a census and several factors such, there is no reliable or reliable caste-based census data that can be the basis of any constitutional exercise or law such as ordering in receipt, The selection of promotional or local bodies, “the center said in the answer while opposing Maharashtra’s request for the data of Frtom SECC.
