Mumbai: The Supreme Court on Friday canceled the suspension of 12 Bharatiya Janata Party (BJP) of Maharashtra’s assembly for a year over alleged incident chairman with officers.
The Apex Court called unconstitutional and arbitrary suspension.
MLA has moved the Supreme Court to challenge their one-year suspension in July 2021.
The state government accused 12 Mola ‘Bad Behavior’ with the officers of the Jadhav Bhaskar chairman in the speaker room.
12 suspended members are – Sanjay Kute, Ashish Shelar, Abhimanyu Pawar, Girish Mahajan, Atul Bhatkhalki, Parag Alavani, Harish Pimpale, Yogesh Sagar, Jay Kumar Rawat, Narayan Kuche, Ram Satty and Bunty Bhangdia.
Reacting to his development, the BJP leader Devendra Fadnavis said that they welcomed and grateful to the Supreme Court for the historical decision to suspend 12 BJP MLA suspension of us who struggled for the cause of OBC in the Monsoon session.
“This Hon SC decision will save democratic values ​​and it is another tight slap in the presence of MVA GOVT because it is not constitutional, unethical, unfair, actions & illegal & undemocratic activities,” Fadnivis said in a series of tweets.
“It’s not just a question of 12 MLA but more than 50 Lakh residents in this 12 elections,” Fadnivis said, added, “democracy saved.” On January 12, SC said the suspension of 12 BJP MLA for one year was worse than expulsion and in accordance with constitutional provisions, constituencies could not be changed for more than six months.
The court has added it will set a “dangerous precedent” if the selected member is removed from the house for a long duration.
