Pune: The additional court session SP Ponkshe here is punished and declaring a 26-year-old software engineer to five years in a tight prison, besides, forcing Rs 6LAKH either, to post video clips with his relationship with his girlfriend with his website.
The court ordered that RS5LAKH of the amount of fines will be given to women as compensation.
“The convicts, who were arrested on February 1, 2011, and were released on the 24 February 24th in the same year, soon to be arrested after a punishment on November 30 and sent to Jerawada Central Prison to serve his term,” additional public prosecutor Leena Pathak to Toi on Monday.
Pathak said, “This is the first confidence by the court session in Pune for violations below the Section 67-A of the Information Technology Act (IT).” Apart from this, the court also punished the defendant for violations below Section 292 (2) (a) IPC, which relates to sexually explicit material.
The Ponkshe judge relied on the evidence recorded by the witness of the main prosecution, including the woman, his brother and his friend (who first saw obscene video clips on the website), internet cafe owners, computer experts and investigation officers Deepak Savant, including seizure pananganama from Various electronic gadgets, received by the defendant.
Referring to the detailed evidence, the court observed that the prosecution had proven that the defendant “made and prepared an object in electronic form, the video of his sexual relations with the victim” and the video was found in his ownership, it was downloaded and restored by investigative officers under Part 27 of Law Invite Indian evidence.
The court, however, freed allegations of accusations repeatedly raping women between November 2009 and May 2010 with the pretext of marrying him and cheating on making false promises.
It observed that the evidence of women showed several episodes of consensual physical relationships.
