Justice Nicola Davies and Justice Saini lowered the recipient of judgment to give Indian government permits to appeal the decision by the Judge court not to extradite Kuldeep, said evidence of India “was not accepted”.
Because permission to appeal is not given, India cannot appeal to the Supreme Court and Singh will remain in the UK.
The Indian government accused Singh to plan a terrorist attack and murder in Punjab.
The trial took place on November 16.
The judges rejected India’s request for permission to app for the fact that the only reliable evidence of India was a police interrogation report about two Kuldeep charges in India.
Davies ruled the evidence was unacceptable because they were a summary produced by a police officer accused of being together “which seems to have been interviewed with the absence of a lawyer and who has not signed the statement
