Prasagraj: Based on the commandments submitted by the court, the state authorities on Friday produced a compliance report before Allahabad the High Court, stated that in the removal of the structure and encroachment, which was carried out after 1975 in Chandrashekar Azad Park in Prayagraj.
However, Applicants Jitendra Singh Vishen, who appeared directly in front of the court, filed that all structures / encroachment were not deleted.
The applicant’s submission was highly contested by official respondents.
Remembering above, the division bench consisting of acting Judge Munishwar Nath Bhandari and Justice Piyush Agrawal directed official respondents to submit information on the effects of the appropriate APEX assessment in the case of Allahabad Ladies Club versus Jitendra Nath Singh and others, (2007) 11 SCC 609 has been made and all increased / construction / encroachment has been removed from the park.
The court then directs that the affidavit mentioned above will be submitted within a week with a copy of the advisor for the applicants.
The fixed court October 21 as the next hearing date.
The court also directed that a copy of the Compliance Report would be given to advice for the Petitioner during the day.
Previously, on October 5, 2021, this court has directed the Government of Uttar Pradesh to delete, within three days, all encroachment included a grave, mazar or mosque built or created in the Chandrashekhar Azad Park area in Prayagraj, which was previously known as Alfred Park .
In addition, the court, while referring to the APEX court decision in the case of Allahabad Ladies Club versus Jitendra Nath Singh and others (2007) 11 SCC 609, has directed the authority that all illegal encroachment in the park that appeared after 1975 should be said.
