Prayagraj: The High Court of Allahabad has directed the Uttar Pradesh Government Advisor to seek instruction (information) from the state government in the writing petition submitted by Dr.
Kafel Ahmad Khan, challenging his suspension from the Brd Medical College, Gorakhpur.
Dr.
Kafel, a pediatrician suspended from service on August 22, 2017, from Brd Medical College after the death of around 60 babies in the hospital due to lack of oxygen.
Hearing the Writ petition submitted by Dr.
Kafel, Yashwant Varma Justice on July 29 which was directed at registering this case on August 5 for the next hearing.
In the current WRIT petition, the Petitioner Dr.
Kafel has challenged the suspension order on August 22, 2017.
Additional challenges have also been carried out for the command 24 February 2020 which was approved by the Disciplinary Authority, which has received a report submitted by a conditional investigation officer with refunded findings Investigator officers in connection with two charges and directed further investigations to do.
Previously, the Petitioner approached this court by proposing a warrant (NO-3511 of 2019) on the grounds that even though he had been suspended by returning in 2017, the investigation process had not been concluded to archiving the petition.
Acting on this paper petition, the court with the order dated March 7, 2019 was thrown away from a direct petition with the direction to the respondent to conclude an investigation within three months.
Based on the direction towards the High Court, the investigation officer submitted his report on April 15, 2019.
After that, the disciplinary authority chose to challenge after almost 11 months.
Recording this, the court observed, “the delay in taking further action in the part of the disciplinary authority is not explained.
Respondents are also obliged to justify the continuation of the sequence of suspension that continues for more than four years”.
It was also continued by the applicant that as many as eight people were suspended along with him in the case of this oxygen deficiency, but they had all been restored except the applicant.
