Prayagraj: High Court of Allahabad on Friday directing the Government’s Higher Education and Uttar Pradesh (UPHESC) commissions to submit their respective counters (counters affidavits) in response to the petition that accused the Commission forced his contract employees to join as an outsourcing contractor employees.
While passing the direction above, the court leads that the applicant will be allowed to continue the work of the commission in the way previously carried out during the suffering of the petition.
Hearing the writing petition submitted by One Mahaboob Ali, justice Ashwani Kumar Mishra was directed at registering this case after the end of a two-week period.
The applicant was involved as a computer operator / officer on the basis of the contract by the Commission in 2011.
Furthermore, the Commission began making efforts to involve it as an outsourced employee of a contracting employee.
Appeared in the name of the Petitioner, his advice Tanisha J Monir argued that the applicant had worked satisfactorily over the past 10 years.
However, on September 2, 2021, an order was passed by the Commission, which forced the applicant to join as an outsourcing employee of a contractor.
The court after hearing the parties concerned observed, “Prima Facie, this court did not find a good land for the commission to force the applicant to function as an outsourcing employee of a contractor involved by the Commission.” The court while remaining 2 September, 2021, asked the state government and the Commission to submit their respective replies in the case within two weeks and directed to register cases after the end of a two-week period.
