HC slams the CBI to investigate ‘unsatisfactory’ to the death of Jaunpur guards

Prayagraj: The Central Investigation Bureau (CBI) because of his failure to investigate the death of the custodian of a 24-year-old man from Jaunpur, the High Court of Allahabad has observed that the written statement submitted by the CBI was completely unsatisfactory as it was indicated that there was no concrete effort made by him to arrest the accused people, who are police.
Hear WRIT petitions submitted by One Ajay Kumar Yadav from Jaunpur District, a division bench consisting of Surya Prakash Kesarwani justice and the agrawal piyush justice observing, “Averment made by the CBI that the effort was made, it seems that the eyewash seen stands on the last date Hearing as recorded in the order of October 27, 2021 that CBI’s arrest was accused of only after the investigation.
“In his written statement, the CBI provided details of police officers, suspects and accused people and also stated that efforts were made by raids / searches in their known addresses, checking Their CDRS / IPDR, and spread sources to get their location the implementation of non-baildle warrants (NBWS).
It was also stated that the arrest warrants had been issued by the local police from the Judge Court, Jaunpur on September 6, 2021.
However, the court noted that the person accused had not been arrested even after more than two months.
However, in the order of November 10, the court gave another chance to the CBI to investigate the case correctly and implement an arrest warrant without further delay and to take all the consequential actions as provided in the Code of Criminal Procedure (CRPC), including the provisions of Part 82 and 83 CRPC, which with him is accused of being stated as absconders and its properties attached.
Finally, the court called for a written statement from the CBI on the next date, i.e., November 29, 2021.
The CBI has been asked to clarify its attitude on the previous submission that the CBI only complete investigations.
Previously, at one stage, this court has transferred the probe of the alleged death of a 24-year-old man in police custody in Jaunpur Regency this year to the CBI, while observing that “all police efforts somehow gave a clean chit to the defendant”.
Allegedly by the Petitioner that the Baksha police station police team in Jaunpur District was forcibly took Krishna Yadav aka Pujari, who was around 24 years old, on February 11, 2021 in the alleged fake case and detained him at the police station.
When the informant (brother died) went to the police station, he was not allowed to meet his brother and the next morning (February 12, 2021), he was told that his brother (Pujari) had died.
After that, a case was registered against police officers accused of under the 302 section (murder) and other parts of the Indian criminal code at the Bercacity Police Station.
On the other hand, the police claimed that the young man was arrested when he rode a motorcycle that fell because he received an injury and the public hit him.
In accordance with the police version, when he (the young man detained) was sent for first aid together with an inspector and two police officers, doctors at the Public Health Center referred him to the district hospital, Jaunpur, and when they reached the district hospital, he was dead.
