Prayagraj: The High Court of Allahabad has refused to guarantee the rape of a gang accused, saying that women folk is not a commodity to be used in such a way.
The court also recorded in his decision that the defendant was involved in the incident, where the rape victim’s body was “served mercilessly and was mashed by three primitive homoceepians, which were unacceptable in civilized society.” Refusing the Bail Application from one Meerut District, justice Rahul Chativedi further said that the violations allegedly carried out by the defendant did not deserve sympathy for civilized communities.
Courts heard a criminal appeal submitted against judges and order skipped by Judge SC / ST Act, Meerut, rejected the Vashu Guarantee Application, which faced prosecution in the case registered against it U / S 376-D (gang rape), section 377 (no violation Naturally) and other parts of IPC and part 3 (2) (v) Act SC / ST.
In accordance with the FIR registered in this matter, on September 14, 2020, one Raghav Tyagi gave a ride to the victim in his car and took him to several remote places where he along with two other people brutally attacked him and left him after doing rape to him.
In his statement, the victim extensively reaffirmed the story of the prosecution mentioned in the FIR and he also stated that he was often a matter of harassment on cellphones by people accused.
He also mentioned that after sitting in the car, he found two other people who sat in the car and the driver of the car suddenly started the vehicle, and after that, everyone mercilessly committed a violation of honesty with him in the most horny way.
He also identified Vashu the applicant at this time between the three attackers.
Therefore, in his decision on October 1, the court did not find faith and illegality in the court order denying guarantees to the defendant, Vashu, and therefore, the court refused the current appeal.
