On BJP MLA plea, HC Inquires Gzb DM tofile Response on black-marketing of oxygen

Prayagraj: The Allahabad high court recently led the district magistrate, Ghaziabad to record his private affidavit at a PIL alleging black-marketing of oxygen at the district, leading to deaths of many Covid-19 patients throughout the next wave of this coronavirus pandemic. The court asked the DM to submit the record of this inquiry instituted by him in this respect after a complaint filed with the petitioner Nand Kishor, a sitting MLA by Loni meeting constituency of Ghaziabad, alleging participation of Shailendra Kumar Singh, ADM (City), Ghaziabad plus a few other men at black-marketing of oxygen. Hearing the PIL filed with the BJP MLA, a division bench comprising Justice Sunita Agarwal and Justice Sadhna Rani (Thakur) led to place this thing on June 7, 2021 for another hearing. From the PIL, the petitioner asked the court to lead a CBI probe from the ADM (City) and several other persons because of their alleged participation in black-marketing and illegal diversion of oxygen into Delhi, Haryana, respectively,”leading to the deaths of dozens of Covid sufferers in Ghaziabad and neighboring regions”. Looking on behalf of the petitioner, senior advocate SFA Naqvi claimed the ADM (town ) had been in-charge of oxygen supply in Ghaziabad, also beneath his nose black-marketing of oxygen had been occurring. “Ghaziabad has a lot of oxygen crops and can readily sustain and match the whole oxygen requirement from the area. Regardless, the town was facing a lack of health oxygen and there’s a sheer violation of taxpayer’s rights guaranteed under Article 14 (right to equality), Article 21 (right to life and personal freedom ) and other terms of this constitution of India,” the older urge claimed. So as to show that his allegations, the petitioner had registered some sound and video clips together with the request. Looking on behalf of this state authorities, added advocate general Manish Goyal filed prior to the court that deficit of oxygen wasn’t reported said district throughout the time of criticism, which was at the previous week of April, 2021, and the allegations in this respect from the writ petition are still indicative. The AAG further declared an inquiry was instituted from the DM about the criticism (dated May 1, 2021) registered with the petitioner prior to the senior superintendent of police (SSP), Ghaziabad. An order dated April 5, 2021, was passed from the district magistrate appointing Ms. Asmita Lal, chief development officer (CDO), Ghaziabad as query officer to check into the allegations levelled the criticism of the petitioner. He, however, admitted that the query report hasn’t yet been filed up to now. On that, the court led the DM to document his personal affidavit, draw on record that the query report and mended June 7 as the next date of hearing in the situation. The order has been passed on May 21 and arrived in public domain on May 24.
