Prayagraj: Observing that ‘All police efforts somehow gave a clean voice to the defendant’, the High Court of Allahabad had transferred the probe into the alleged mortality of a 24-year-old man in Jaunpur at the Central Bureau of Investigation (CBI).
Hearing the writing petition submitted by one ajay Kumar Yadav from Jaunpur, a division bench consisting of Solar Justice Prakash Kesarwani and justice Piyush Agrawal transferred the probe while underlining that if investigation was ineffective, aiming, the court could, if considered necessary, ordering a fair investigation , further investigation or return investment properly, to find the truth to prevent miscarriage justice.
It was alleged that the police Jaunpur was forcibly took a young man – Krishna Yadav aka Pujari – on February 11, 2021 in a breeding case and detained him at the Buksa police station.
When the informant (brother died) went to the police station, he was not permitted to meet his brother (the deceased), and the next day in the morning on 12 February 2021, he received information that his brother had died.
After that, a case was registered against police officers accused of under the 302 (murder) section and other parts of the IPC at the Buksa Police Station from Jaunpur Regency Up.
On the other hand, the police claimed that the deceased was arrested when he rode a motorcycle that fell, because he received an injury and the public hit him.
Furthermore, it was declared that when he was sent for first aid along with sub-inspectors and two policemen, the doctor at CHC referred him to care to the district hospital, Jaunpur, and when they reached the district hospital, he gave up.

Due to the death of the custodian, judicial investigation was entrusted to this matter to the judiciary (CJM), Jaunpur, and recorded a statement of 16 witnesses, however, it did not reach a conclusion.
After going through the case record, the court observed in his assessment on Wednesday: “All police efforts somehow gave a clean chat to the defendant and for this purpose, important evidence is destined and some evidence is being made and manipulated.
But at this time we do not want to comment on again because the fair investigation has not been carried by an independent agent and impartial.
“Transferring the probe to the CBI, the court posted this issue as fresh for further hearing on September 20, 2021.
