Prasagraj: Violence, Torture and Death in detention is always a concern for civilized society, observing the High Court of Allahabad on Wednesday for denying guarantees to a police officer who was ordered for causing the death of a man’s custodian in 1997.
Refusing the Guarantee Application of Police Sher Ali, justice Samit Gopal was observed, “Custodial violence, Custodian torture and Custodian’s death is always a concern for civilized society.
Time and more court decisions from the APEX court and other courts have demonstrated their concerns and sadness in such things.” The court also quoted the verdict.
Justice from the peak court in the case of DK Basu vs.
West Bengal state, where the peak court, while expressing his sadness for his custod death, has issued guidelines for examining the incident.
The complainant, Sanjay Kumar Gupta accused that on December 28, 1997 several police officers came to their homes and took their father Gokrakhnath aka Om Prakash Gupta.
Then, he was told by the police that his father had died of a heart attack.
Denying the version provided by the police, the reporting accused that his father was merciless and inhuman because he died at the police station itself.
A pine was registered against the applicant below section 364 (kidnapping or kidnapping to kill), 304 (murder guilty) and 506 (criminal intimidation) IPC.
