Bengaluru: The Karnataka High Court has given temporary approval for udupi women to hold a service meeting at his home with a warning that there should be no big congregation and such a meeting should not cause interference in the environment.
Orders, which will be valid until the next hearing is likely after the court winter vacation, was passed on Wednesday by Justice Krishna S Dixit after the Petitioner Estela Louies provided an effort from his advice.
In his petition, Eshela said he was involved in community service activities and had made prayers at his residence in Devaldada in Kundapura Taluk from the district on Friday and Sunday for the past 11 years.
He challenged the October 26 notice issued by the Station House Officer of the Kundapura Police Station, claiming to violate his fundamental rights guaranteed under the constitution.
In his efforts to court, the applicant said he would ensure there would be no major church to avoid the possibility of the risk of the spread of Covid-19 and no interference or disturbance in the environment.
He also said he would not provide scope for conversion level charges.
The applicant said that every violation of the condition would result in the rescue of the temporary order, and the police and other jurisdictional authorities could take the right action against the concerned.
The applicant has agreed that the police are free to make audio or video recordings from meeting activities.
“The above conditions are imposed to eliminate the strong submission of additional government advocates that the area is communal sensitive, the church tends to endanger peace and harmony and the law of danger and order,” Judge Dixit has observed the problem, directed this problem, directed this problem to post after the holidays winter.
Kundapura police, in their notification, said he held a meeting without a license from the police and it was a violation of the law.
Therefore, they asked him to submit documents at the police station.
According to Eshela, he has submitted a response that he did not need police permission to pray because he was under his religious rights.
After the notification was issued, he said, he was not permitted to offer prayers at his home and the police had warned him that his friends and relatives would be arrested if they came to pray.
