Bengaluru: In a big assistance to BMRCL, the High Court on Thursday allowed him to remove 577 trees along the alignment of the Nagawara-Gottigere Metro in accordance with the Tree Expert Committee report (TEC).
This order was forwarded on office memorandum (OM) submitted by BMRCL on November 26.
Two more submitted in the second week of this month was delayed when the applicants wanted to file an objection.
Recording BMRCL filing that there is a daily loss of Rs 2 Crore / escalation fee because the project is cut to the desire of permission to cut trees, a division bench led by the Chairperson of the Ritu Judge Raj Awasthi said the project must be completed in time in a time bound.
The bench said the November 18 expert committee report said that of 833 trees examined, 44 was found suitable for retention and 212 for translocation, thus saving 256 trees.
Must go with the report: HCRESPONDING against the Applicant’s mind about the need to cut 577 trees, Bench said the court is not an expert about this and must be continued with the TEC report.
“We have the view that the expert committee report formed by this court will be accepted.
There are several variations in the number of trees mentioned in the DPR and TEC reports, does not mean the committee has not really done the work in accordance with the process described in the order of December 9, 2020 the Court.
There may be variations as the initial DPR prepared in 2016 while TEC examination was carried out after December 2020, “added the bench.
Advice for the Petitioner said according to the DPR November 2019, only 1,218 trees would be affected, but if the three OMS were put together, the total number of trees affected would be 2.115.
The court listened to pills by Bangalore’s trust and Dattatraya T devare, an environmental lover.
Applicants seek the Constitution Committee / Task Force to ensure tree officers and tree authorities carry out their functions in accordance with the provisions of the Conservation of Karnataka from Tree Act, 1976, and Conservation of Tree Rules, 1977.
In June the interlocutory application was submitted by the Applicant who was looking for court intervention on the court Cut the tree along the Nagawara-Gottigere alignment.
