Bengaluru: Observing that the cricket bet that was allegedly no exception under the Police Law Karnataka (Amendment), 2021, the Dharwad bench from the Karnataka High Court has refused to cancel the trial that began with three accused of Jamakhandi Regency in Bagalki Regency.
This case was registered after the RAID conducted on November 10, 2021, in a house near the Temple of Danammadevi from Kunchanur Road in Jamakhandi.
Rajasshekar and the other two challenged the trial that began against them by the Jamakhandi police.
Destroying their petition, Judge HB Prabhakara Sastry has shown that the reading of the Old Parts 78 (1) (a) (A) (VI) Karnataka Law (Amendment) makes it clear that online games – involving bets or bets, including computer resources or applications cellular or internet or any communication device – also a violation.
The judge has said betting where the receipt or distribution of winners or prizes in money or vice versa, which is made to depend on coincidence, now also includes ‘other skills’.
Based on amendments, after section 78 (1) (a) (vi), clause (vii) is also included.
According to him, betting or bet “on each action to take risks or vice versa on unknown results of an event included in the skill game” is a violation, the judge has noted in its order.
Furthermore, it shows that the same, Part 2 (7) of the Changed Act defines the game to enter online games too.
“Therefore, the cricket bets are thought to be no exception from section 78 (1) (a) read with section 2 (7) of the KP Law,” said the judge.
“There is no cash found from the applicant.
No one suggests they are involved in playing games or gambling,” said the court.
However, the Petitioner of the Government of the High Court submitted that based on the definition of an amended ‘game’ and amendments in Section 78 (1) (A) (VI) (VI) from KP Law, the action of the waterfall in the ambit online gaming and betting.
The court was told that since the case of the Prima Facie was made against the applicants, experiments must be followed after being investigated.
