The government should not make a transfer policy mockery: HC

Shimla: Taking a strong exception to the government that transferred employees on the recommendations of constitutional authorities, the Himachal Pradesh High Court has directed the main secretary to take the right action in this matter.
It’s time to turn the state government reminded that the transfer policy should not be taken lightly or make ridicule, the court observes.
The Division of Judge Tarlok Singh Chauhan and Justice Jyotsna Rewal Two passed this order on the writing petition submitted by one Vifender Kalta to the transfer order.
The applicant has accused that the transfer has been made based on DO records and, therefore, legally cannot be maintained.
While allowing petitions, the court observed that the government was the best judge to decide how to distribute and take advantage of its employees, however, this power must be done honestly, reasonably and public interest.
Courts and courts are not expected to carry out administrative system work by transferring officers to the right place but it becomes necessary (for the court to interfere) when gross irregularities carried out by the government in such things are noticed, he added.
