Chandigarh: The Punjab High Court and Haryana have directed regional passport officers to remove the repaired passport to the minor by entering the names of his adoptive parents in the place of biological parents.
HC also explained that every adoption through registered deeds must be held valid and passport authorities must entertain the application for passport issuance according to the document.
Justice Sudhir Mittal from HC passed this order after regional passport authorities refused to improve underage children’s passports adopted by a partner.
In this case, the Petitioner, 16, a resident of Faridkot Regency in Punjab was adopted by the pair of Satpal Singh and his wife Paramjeet Kaur through an adoption deed registered on September 17, 2019.
After that, the application on September 9, 2020, was moving for a passport correction so that it entered the name The name of the adoptive parents, but was rejected by the passport authority.
Harmed by this order, minors have approached HC.
Advice for the applicant has proposed that the applicant was adopted because the biological parents were not financially healthy.
Adoption is done as a biological father of the applicant is a lift man.
The registered adoption certificate has not been challenged by anyone to date.
Biological parents also submit a written statement that they have no objections to combining the names of parents lift in the passport, however, the correction is not made.
Contrary to the request, passport authority, however, was submitted that according to section 11 of the laws and maintenance of Hinduism 1956, there was no adoption that could be done if the adoption parent had a previous daughter.
Being invalid adoption, the names of adoptive parents cannot be included in the passport.
After hearing all parties, HC ordered the authority of the passport to improve the Petitioner’s passport by entering the names of his adoptive parents and observed that adoption through registered actions must be held to see part 16 adoption and maintenance of Hinduism acting reading with part 15 of the law.
Explain the assumption to document documents relating to adoption, part 16 of the ACT said, “Every time a document registered under whatever laws is currently produced before the court intended to record adoption and signed by the person giving and people who takes children in adoption, the court will assume that adoption has been carried out in accordance with the provisions of this action except and until denied.
